HEMP BILL – THE CURRENT REGULATORY STATE OF PLAY
In December 2018, the 2018 Farm Bill was signed into law. It removed hemp, defined as cannabis (Cannabis sativa L.) and derivatives of cannabis with extremely low concentrations of delta-9-tetrahydrocannabinol (THC) (no more than 0.3% THC on a dry weight basis), from the definition of marijuana in the Controlled Substances Act (CSA).
The 2018 Farm Bill preserved the FDA’s authority over hemp products. As such, hemp-derived products must meet applicable FDA requirements and standards just like any other FDA-regulated item. These include regulations for foods, dietary supplements, drugs, and cosmetics.
In 2018, the FDA cleared three hemp seed-derived food products as Generally Recognized as Safe (GRAS): hulled hemp seed, hemp seed protein powder, and hemp seed oil. These products do not contain CBD or THC and are legal in the U.S. food supply under standard food safety laws.
